Under the Michigan Wrongful Death lawsuit, the surviving family members and dependents are entitled to damages as a result of the death of their loved one. In a wrongful death action, a probate estate must be opened and a Personal Representative appointed by a Probate Court in order to file a lawsuit. Payments to survivors must be authorized by the Probate Court which will determine distribution of the proceeds in the event of a wrongful death.
